NON COMPREHENSIVE SUMMARY OF OUR TERMS AND CONDITIONS

Delivery: to reduce the carbon footprint, all deliveries are handled by Bpost as standard shipments. For more information about shipping prices please refer to the  “Delivery & Returns” section. TA-CT offers free delivery for orders over 130 € and for all orders placed from Belgium.

Cancellation rights: at TA-CT, we have decided to extent your cancellation rights to all Products, including undewear items, and to double the legal duration of these rights, which are extended to 30 calendar days. To make use of these cancellation rights, the Customer must notify TA-CT by email at contact@ta-ct.com with the subject “Return” within 30 calendar days following receipt of the Product(s), indicating the order number and the item(s) being returned.

Refund: TA-CT will refund the Customer the cost of the returned Product(s), including the delivery cost, but excluding the return costs and any possible customs duties.

Exchange: We do not offer an exchange service, so should you wish to change size or style please place a new order online and return your initial order for a refund.

Warranties: all products offer a two-year warrantie.

Privacy Policy: TA-CT does not share your personal data, except with subcontractors and third parties who provide services on our behalf to assist us in our business activities. We do not store credit card details. We will not use any personal information for commercial or promotional communications, except with your prior explicit consent given by subscribing to our Newsletter. Please refer to our “Privacy Policy” for more information.

1. Identification of TA-CT and contact

The Website www.ta-ct.com belongs to the company TA-CT srl. The brand “TA-CT” sells underwear, clothes, objects and accessories. TA-CT srl is duly organized and existing under the laws of Belgium – whose Intracommunity VAT number is: BE 0668 413 340 – and whose registered office is situated Rue du Printemps 11, 1050 Brussels, Belgium.

2. Scope and acceptance of the Terms and Conditions

The purchase of Products offered on the website www.ta-ct.com (hereafter the “Website”) is subject to the following Terms and Conditions (hereafter the “T&Cs”).
TA-CT Products (hereafter the “Product(s)”) are exclusively intended to be sold to end Customers (hereafter the “Customer(s)”).
Please note, these terms and conditions can potentially change at any time, please refer regularly to the up-to-date T&Cs.
Customers can familiarise themselves at any time with the current applicable version of the T&Cs by clicking on the link “Terms and Conditions”.
With each purchase of Products on the Website, the Customer shall be asked to confirm the acceptance of applicable T&Cs. The said T&Cs can be viewed at the time the Customer is asked to confirm that they accept them.

3. Terms of the Order

All orders are subject to express acceptance of the T&Cs, the prices, and the Product’s availability.

To place an order the Customer must follow the steps below:
– The Customer must select the Product, size and colour.
– The Customer checks the content of the basket with the opportunity to delete the Product(s) selected.
– The Customer must complete the identification form and provide the requested information (title, surname, first name or corporate name, email address, invoicing address, delivery address, telephone number for the delivery…).
– The Customer checks the content of the order, the total price, the delivery and invoicing addresses with the possibility of deleting Product(s) or modifying the invoicing or delivery address. The Customer confirms the method of delivery and payment. The Customer must confirm the acceptance of these T&Cs by checking the corresponding box.
– The Customer receives an email confirming the details of the order. This email is not an acceptance of your order.
The order is then registered and processed by TA-CT which checks the availability of the Product(s) ordered.

Non-acceptance of an order may be a result of one of the following:
– The Product(s) ordered being unavailable from stock.
– Non-authorisation of the payment.
– The identification of a pricing or Product description error.
In the event of the order not being accepted, TA-CT shall inform the Customer by email or by phone as soon as possible, and offering another Product available on the Website as an alternative, or canceling the order at no cost.

The Customer receives an email confirmation summarising the content of the order and confirming the dispatch of the same. The contract is deemed to have been concluded on the date on which this email is sent.

A carrier tracking number is provided to the Customer when the order has been confirmed. The Customer furthermore receives information by email concerning the different stages of the processing and preparation process of the order until it is shipped.

4. Price

The prices, expressed in euros, are those as shown on the Website at the time the Customer places their order, subject to availability of the Product ordered at this time. The prices include VAT and administrative costs inside Europe and exclude taxes and customs duties for orders outside of the EU, which shall be borne by the Customer. Product prices do not include transport costs: these will be charged separately, and the Customer must pay them in addition to the purchase price. TA-CT shall not reimburse the VAT applied to purchases made on the Website, except in the case of cancellation or refund under warranty.

In the event of unavailability of certain Products ordered, only the price and shipping costs related to the available Products shall be debited.

TA-CT reserves the right to change at any time the prices of Products offered on the Website.

All the orders are payable in euros and must be settled immediately upon placing the order.
Products will remain TA-CT’s property until such time as the Customer pays the purchase price and costs in full.

5. Payment methods

By Visa, MasterCard, American Express, Carte Bleue, Maestro, Bancontact, PayPal, Sofort, Ideal, Apple Pay and Google Pay.

The Customer certifies they are authorised to make payments by one of the payment methods as stated above, and that there are sufficient funds in the bank account linked to the credit card to cover all the costs arising out of the transaction. In the case of the Customer’s bank refusing payment, the order will be cancelled automatically.

TA-CT uses Stripe to handle payments online. The security system used by Stripe are certified PCI DSS and are one of the most secure and reliable in the world. TA-CT has no access to its Customers’ confidential payment details.

TA-CT reserves the right to refuse any order from a Customer with whom it is in dispute or who has brought a dispute in the past, and may also refuse an order should the Customer not have paid for a previous order, wholly or in part.

6. Terms and conditions of delivery

When confirming their order, the Customer chooses delivery to a given address (home, work, or other). TA-CT will do its best to ensure that the order is dispatched to that address within a few days of confirming the order.

Due to inventory and packaging requirements, TA-CT reserves the right to split orders into one or more deliveries as Products are available. Please note that you will only ever pay once for shipping, even if the particular items in your order have to be shipped separately. Deliveries will be accompanied by a “Return form” which also gives details of the goods delivered.

All orders are shipped with Bpost. The carrier will attend the address specified between 08.00 and 18.00 on working days and will hand over the package(s) to the Customer, or another person present at that address. If no-one is there, a message will be left to arrange another delivery, either to the same address or to another address or to one of the collection points.

The Customer or a person of their choice must check the condition of the Products at the time of delivery, and if necessary indicate on the delivery note any damage before signature of the carrier’s delivery note. In case of damage to the delivered items, the Customer must also send a description of this damage to TA-CT via email within 3 working days following receipt of the article(s).

In the event of an incomplete or incorrect address, inability to place the parcel in the Customer’s letterbox, refusal of the parcel by the recipient, lack of information making it impossible to deliver the Product to the recipient, TA-CT cannot be held responsible for the non-delivery of the item. If it is impossible to effect delivery, the order will be returned to TA-CT automatically, who will then contact the Customer to arrange for the order to be delivered, in which case the Customer may be asked to pay additional delivery costs.

TA-CT cannot be held responsible for any action and/or costs and/or taxes (which fall under the Customer’s responsibility) and/or delays due to customs regulations over which it has no control.

The average period between an order and its delivery is from one to ten working days, depending on the destination country. The Customer is further informed that in some special cases (e.g. customised Products), the periods indicated above can be longer. If TA-CT fails to deliver within a period of 30 days from the date of the order, the Customer may cancel the said order at no cost. The sums paid will then be reimbursed.

If TA-CT or the carrier are responsible for the loss of the parcel during the delivery process, TA-CT will send a new shipment entirely at its expense if the Product(s) is/are still available, or otherwise refund the value of the order including transport costs. However, from the time when the Product(s) is/are delivered, the Customer is responsible for the loss and/or damage of the delivered Product(s).

As detailed before, in case of damage to the delivered items, the Customer must send a description of this damage to TA-CT via email (contact@ta-ct.com) within 3 working days following receipt of the article(s). In the event that the Customer does not wish to accept the Product(s) due to damage when TA-CT has been notified and agreed that the items are damaged, the Customer will receive via email instructions for a free return and a return number to note on the “Return Form” on the parcel. The Customer has 14 working days following receipt of these instructions to return the Product(s). Product(s) must be returned in their original condition (packaging, accessories, etc.). No parcel shall be accepted without the “Return Form”. The return and reimbursement shall occur without costs to the Customer, with the exception of possible customs duties.

The Incoterm® we use for deliveries is DAP Incoterms® 2020, which means that we are in charge of the delivery to the address indicated by the Customer, but that possible taxes and customs clearance costs for deliveries outside Europe shall be borne by the Customer.

7. Cancellation rights

Under Articles VI.47 and VI.67 of the Belgian Code of Economic Law, Customers have a right to cancel their order, except when it contains underwear items. However, at TA-CT we have decided to extent the cancellation rights to all orders, including orders of underwear items, and to double the legal duration of the cancellation rights, which are extended to 30 calendar days from the delivery date. The Customer shall not have to justify the reasons or pay penalties, with the exception of possible customs duties.
The cancellation rights are not valid for Product(s) made-to-order or customized specifically on behalf of the Customer, such as items dyed on request.

To make use of these cancellation rights, the Customer must notify TA-CT by email (contact@ta-ct.com) with the subject “Return” within 30 calendar days following receipt of the Product(s), indicating the order number and the item(s) being returned. If your return is from outside Europe, please let us know so that we can send you by email the customs documents to enclose with your package.
The cancellation rights apply if the Product(s) is/are returned within 20 calendar days of the Customer notifying TA-CT that they wish to revoke their purchase (or part of it).
After this 20 calendar days, TA-CT can no longer accept returns and will return the items back to sender, with the costs and risks pertaining to this return borne by the sender. Any returns for which the sender cannot be identified will be refused.

Returns will only be accepted if the items have been tried on carefully and with your own underwear underneath. Any returned pieces with remnants of lotion, deodorant, perfume or stains won’t be accepted.
The Product(s) must be sent back as new: in its original packaging, in perfect condition, with its label attached, unworn, unwashed, and accompanied by all of its accessories.
Please use the “Return Form” that is enclosed with the delivered Product(s) to mark the items being returned.

Returns must be sent to the address below, which is also stated clearly on the “Return Form”:

Customers must return items back to us at their own cost, using a carrier of their choice. The risks involved in returning the items will be borne by the Customer and therefore we suggest the Customer uses a tracked service. We cannot be held responsible for items that fail to reach us.

On receipt of the returned Product(s), TA-CT shall send a confirmation of receipt of the Product(s) by email.

Refund:
TA-CT will refund the Customer the cost of the returned Product(s), including the delivery cost, but excluding the return costs and any possible customs duties. This refund will be done within a maximum period of 14 days following receipt by TA-CT of the returned product, by bank transfer into the credit card account used by the Customer. If the Customer paid for their order by some other form of payment, the refund will be credited to the bank account stated on the “Returns Form”.

Exchange:
We do not offer an exchange service, so should you wish to change size or style please place a new order online and return your initial order for a refund.

8. Warranties

In accordance with articles 1641 to 1648 of the Belgian Civil Code all the Products sold by TA-CT are subject to the conditions of statutory warranties.

In case of non-conformity or hidden defects in the Product that make it unfit for the use for which it was intended, or that substantially decrease this use, the warranties will apply provided that the Customer makes the complaint in a period of 24 months following the delivery of the Product.

Any complaint related to the statutory warranties must be submitted by email to the address contact@ta-ct.com followed, if requested, by a written confirmation sent by registered letter with acknowledgement of receipt to Customer services at the following address TA-CT – Rue du Printemps 11 – 1050 Brussels, Belgium.

In the event of non-conformity or of a hidden defect in a Product sold by TA-CT, the Customer shall return the product before any refund. TA-CT will refund the Customer the cost of the returned Product(s), including the return costs but excluding any possible customs duties.

In any event, it shall be for the Customer to prove that they have fully met the conditions of the warranty.

TA-CT shall refuse any complaint about Products that have been used contrary to their intended use.

Due to the dye process and the natural material used, variations of colours or irregularities may occur and are a natural part of the Products. These aspects are therefore not covered by the warranties.

9. Force majeure

“Force majeure” means all external unpredictable and unavoidable circumstances, beyond the reasonable control of the party which is suffering a force majeure case.
TA-CT cannot be held responsible in the case of non-performance of their obligations when this non-performance results from a case of force majeure. If TA-CT is obliged to interrupt the delivery of the order or to cancel it in case of force majeure, TA-CT shall be responsible for reimbursing the Customer for any amounts already paid.

10. Personal data and cookies

TA-CT attaches great importance to your privacy and protects your personal data by applying the General Data Protection Regulation (European Regulation 2016/679 on the protection of personal data “GDPR”).

The order process on the Website www.ta-ct.com requires the collection of personal information (first name, last name, phone number, address, payment details…) The completion of personal information is essential for the processing and delivery of orders. Customer(s) is/are fully responsible for the truthfulness, accuracy and completeness of the information uploaded, shared with or sent to the Website. This information is strictly confidential and intended for TA-CT exclusively. It shall be processed in strict compliance with the provisions of the GDPR.

Customer(s) consent(s) to storage and use of personal data provided when placing an order and when using the Website www.ta-ct.com.

We will not use any personal information for commercial or promotional communications, except with your prior explicit consent given by subscribing to our Newsletter service.

Customer(s) shall at all times have a right to access, amendment, rectification and deletion of the data. You can exercise this right by sending an email to contact@ta-ct.com or by sending a letter to TA-CT – Customer services – Rue du Printemps 11 – 1050 Brussels Belgium. To ensure that the request originates from you, you can only send a request by email from the email address that is known to us or registered with us, or by sending a letter enclosing proof of identity.

Cookies are used on the site in order to improve our website and your future shopping experiences with us. The cookie identifies your computer and allows the site to remember your personal settings. Cookies are also used for statistical purposes. By using our website you consent to the use of cookies for the purposes described above. You can object to the use of cookies at any moment by changing your browser settings. However, the web shop cannot be used if some cookies are disallowed.

By accepting our Terms & Conditions, you confirm also that you have read and understood the content of our “Privacy Policy”, and that you consent to TA-CT having the right to process your personal data in accordance with the provisions herein.

11. Intellectual property

The brand TA-CT and all the contents shown in the Website www.ta-ct.com belong to TA-CT and are protected by the relevant legal provisions. Any reproduction, distribution, manipulation or commercial use of any of the materials such as graphics, images, text, models, icons, trademarks and names is forbidden except with the express authorisation of TA-CT.

Any infringement of this provision will result in legal action.

Customers and visitors sharing any social media content produced by the company on its social media accounts and platforms (Instagram, Pinterest, Facebook…) must include the correct credits and ownership of images. The company and collaborative artists must be credited at all times.

12. Governing law – Disputes

These T&Cs shall be governed and interpreted in accordance with Belgian law.

Complaints or disputes will always be dealt with fairly and thoroughly, and good faith is always presumed in those who initiate them. In the event of a dispute, the Customer(s) should first contact the company to achieve an amicable solution.

If the parties cannot find an amicable solution, the French-speaking courts of Brussels shall have exclusive jurisdiction to hear the case.
